Student Rights in the Conduct Process

You Have Rights

If you are a student who has allegedly violated university policies, it is important to know that you have rights during the student conduct process. Learn more about your rights during the conduct process below.

You have the right to: 

  • A written notice, including a brief statement of the factual basis of the charges, the policies or regulations allegedly violated, and the time and place of the hearing. This notice shall be sent to you within a reasonable amount of time before the hearing.
  • A prompt and fair hearing where the university will bear the burden of proof. You will have the opportunity to present documents and witnesses, and confront and cross-examine witnesses presented by the university. No inferences will be drawn from your silence.
  • An advisor during the conduct process. Advisors may support you, but may not represent you, and cannot be directly involved in the alleged incident. 
  • A record of the hearingThis is a prompt written decision based on the weight of evidence, accompanied by a written summary of the facts found.
  • Access to review information contained in your disciplinary file.
  • An appealInstructions on how to make an appeal will be detailed in your decision letter.

More information on advisors:

  • You may choose a family member, friend, attorney, former coach, faculty member, etc. — as long as they are not directly involved in the alleged incident.
  • Advisors may assist and support you, but may not represent you nor speak on your behalf during the conduct process. You are responsible for presenting your view of the facts and for answering questions during the Administrative Review or Student Conduct Committee Hearing to clarify facts. An advisor may assist you in that effort but may not do it for you.

What about appeals?

You may submit a written appeal to Student Conduct & Academic Integrity Programs, addressing the Dean of Students, within 15 calendar days of receipt of the decision. 

Academic case appeals are referred to an Academic Integrity Committee. They will only review the written appeal, you will not meet with them again.

Appeals under review can result in the original decision being upheld, modified, or overturned.

Written notification of the appeal decision will be sent to all parties that received the original decision.
